Exclusion of liability and indemnity

1. Neither the Pretoria High School Old Boys’ Club (PHSOB) nor the Pretoria High School Old Boys’ Athletics Club (PHOBIANS) and/or any of their management, members, officials, employees, sponsors, organizers, marshals, agents, volunteers and/or contractors (hereinafter collectively referred to as the “Club”), shall be responsible or may be held liable for any loss, damage or injury, including, but not limited to consequential losses, suffered by or caused to any person or participant, his or her dependants and/or executor (the “participant”) or property anywhere on or about the Club’s property or premises, or any other place where the event may be held, whether or not such loss, damage or injury is occasioned by any act, omission, failure or incompetence of the Club, or anyone else for whose actions they or any of them would be liable in law, or by reason of superior or irresistible force, a fortuitous or unavoidable accident, rain or other water, riots, strikes, unrest, theft or burglary with or without forcible entry, or by reason of any condition on or off the grounds of the Club or any building structures, or any defective facilities of the Club, or caused by any other activity carried out on or about the Club’s premises or by any other cause of whatsoever kind or nature and howsoever arising.

 

2. Each participant shall, at all times, hold the Club indemnified against and harmless from and shall in no manner whatsoever seek to hold any of them liable for any injury, loss or damage suffered by such participant as a result of personal injury, loss of life or patrimonial loss arising directly or indirectly from the participation in the event, whether or not such injury, loss or damage can be attributed directly or indirectly to negligence of whatsoever kind or nature or degree on the part of the Club.

 

3. The participant in his or her capacity as father/mother and/or natural guardian of his/her minor children that may participate in the event or make use of the facility of the Club, confirm and agree that the aforesaid exclusion of liability and indemnity, shall equally apply to any damages that may be suffered by his/her minor child or children.

 

4. This exclusion of liability and indemnity is in addition to any other exclusions of liability or indemnities given
